General

1.1 By redeeming a ticket to enter ArtVo or any part of the premises, you are deemed to have accepted these Terms and Conditions and understood them to be binding on you. It is your responsibility to read and inform yourself as to these Terms and Conditions.

1.2 Management reserves the right to refuse entry or remove any person from the premises or any part of the premises for failure to comply with these Terms and Conditions, or for any conduct deemed by Management to be inappropriate, offensive or disruptive.

1.3 Operational hours are subject to change without notice and may be reduced or extended due to operational requirements.

1.4 Management will use reasonable endeavours to ensure that the premises are open for use by visitors during normal advertised operational hours. However, Management reserves the right, in its absolute discretion, to close the premises or any part of the premises as deemed necessary. In the event of such closure or cancellation, ArtVo shall reschedule bookings to an alternative time and/or date but shall otherwise have no liability whatsoever, including no liability for consequential losses or expenses.

1.5 You are responsible for your own personal property and the property of those persons under your care or supervision whilst in the premises. A cloak room is available for the use of visitors to store personal property whilst visiting the ArtVo gallery. However, neither ArtVo, nor its staff or management, are responsible for any loss or damage of any property, even when stored in the ArtVo cloak room, to the maximum extent permitted by law.

1.6 All paintings, systems and materials of ArtVo are protected by copyright and other intellectual property rights. You must not infringe those rights or reproduce them without the prior express written consent of ArtVo and any other persons owning copyright or intellectual property rights in any paintings, systems and materials.

1.7 These Terms and Conditions shall be accepted by visitors either online prior to purchasing a ticket or in person upon arrival by entering the premises whereby you acknowledge your acceptance of the Terms and Conditions also displayed at the point of entry. Visitors must upon request provide their full legal name, mobile number, email address, current residential address, and date of birth. CCTV footage may be used to identify persons as necessary and also verify that the correct person has provided consent.

1.8 Visitors enter ArtVo under a revocable licence. ArtVo retains absolute discretion to refuse or revoke entry at any time without compensation.

1.9 Visitors acknowledge that participation in ArtVo’s interactive exhibits involves inherent risks, including but not limited to tripping, falling, sensory disorientation, or physical injury. By entering the premises, visitors voluntarily assume all such risks to the maximum extent permitted by law.

1.10 Visitors acknowledge the risk of transmission of COVID-19 and other communicable diseases despite ArtVo’s reasonable precautions and voluntarily assume such risks.

1.11 ArtVo may collect, store and use personal information in accordance with the Privacy Act 1988 (Cth) and applicable state laws.

Ticketing

2.1 All ticket prices are displayed at the ticket counter and on the website. All transactions are processed in Australian Dollars (AUD).

2.2 For primary and secondary school group bookings, a minimum of one (1) teacher, parent or nominated guardian/supervisor aged 18 years and above per ten (10) students/children for primary, and two (2) per nineteen (19) students/children for secondary, is required. Terms and Conditions specific to education groups and accessible bookings will apply and are available upon request. Unless otherwise waived by Artvo at entry, schools must sign a pre-excursion agreement accepting responsibility for students. It is required that schools provide a letter of authority authorising a teacher to bind the school to the Terms and Conditions prior to entry being permitted.

2.3 For functions and private event hire, special Terms and Conditions may apply and are available upon request.

2.4 From time to time, ArtVo may sell tickets as an agent for other parties. The services provided shall be in accordance with the Terms and Conditions of the provider. ArtVo shall not be responsible for any loss or damage arising from such services.

2.5 To the maximum extent permitted by law, no refunds or exchanges will be provided on any tickets. Lost, damaged or stolen tickets will not be replaced. ArtVo shall not be liable for consequential losses, damages or expenses, including travel or out-of-pocket expenses.

2.6 General Admission Tickets are non-transferable, non-refundable, and not redeemable for cash. No extension to the validity period is available.

2.7 General Admission Tickets are not valid for ArtVo Special Events.

2.8 An Annual Pass is non-transferable. The purchaser/recipient must be an Australian resident. Proof of residency is required at the time of collection. A $10 replacement fee applies to lost cards. An Annual Pass cannot be used in conjunction with promotional offers and is not refundable once purchased.

2.9 Only persons holding valid tickets, Annual Passes, or Complimentary Passes may enter ArtVo.

2.10 Children aged 4 years and under may enter ArtVo free of charge when accompanied by a paying teacher, parent or nominated guardian/supervisor aged 18 years and above.

2.11 Tickets may not be resold without ArtVo’s prior written consent. Tickets resold without consent may result in refusal of entry without compensation.

2.12 Ticket prices are subject to change without prior notification.

Code of Behaviour

3.1 Visitors must comply with these Terms and Conditions, all rules, directions and safety requirements communicated by ArtVo management or staff.

3.2 Visitors must obey all reasonable instructions given by ArtVo management or staff.

3.3 Visitors must not behave in a manner that disrupts the safety, enjoyment or comfort of others. Offensive, irresponsible, or unsafe behaviour, theft or vandalism will not be tolerated.

3.4 Smoking is strictly prohibited throughout the ArtVo premises.

3.5 No person affected by alcohol or drugs will be permitted entry or allowed to remain on the premises.

3.6 No food or alcoholic beverage may be taken onto or consumed in the premises. Non-alcoholic drinks are permitted in sealable plastic containers.

3.7 Pets or animals are prohibited, except for guide, hearing, or assistance dogs.

3.8 Appropriate clothing must be worn at all times. Persons without shirts, wearing offensive clothing or failing to wear clothing may be refused entry or removed.

3.9 Appropriate footwear, defined as enclosed footwear, must be worn at all times.

3.10 Running is prohibited within the premises.

3.11 Queue-jumping at the ticket counter is strictly prohibited.

3.12 Weapons or articles that may cause injury or discomfort are prohibited.

3.13 Visitors may be required to submit to security checks of their body, clothing or personal items. Failure to do so may result in refusal of entry without compensation, to the maximum extent permitted by law.

3.14 Visitors must not engage in abusive, offensive, discriminatory or aggressive behaviour towards staff or other visitors. Such conduct will result in immediate removal without refund or compensation.

3.15 Visitors must comply with all public health directives and government mandates.

Health and Safety

4.1 ArtVo is an interactive attraction. Persons with medical conditions, infirmity, ambulatory difficulties, autoimmune diseases, or other health conditions are advised to seek medical advice before visiting.

4.2 Strollers, prams, and wheelchairs are permitted. These may be left at designated areas at the owner’s risk.

4.3 Visitors and groups with accessibility requirements are recommended to pre-book.

4.4 Visitors agree that they may be delayed, detained or evacuated in the event of a technical fault or emergency and acknowledge that ArtVo is not liable for consequential loss or inconvenience.

Children

5.1 Children aged under 18 years must be supervised by a teacher, parent or nominated guardian/supervisor aged 18 years and above.

5.2 If you bring children into the premises, you are also personally jointly and severally responsible and liable for their care, conduct, supervision, and any damage caused.

5.3 For school bookings, schools are also fully responsible and liable for any acts or omissions of students while attending the premises. Unless waived by ArtVo at entry, schools may be required to sign a pre-excursion agreement and provide a letter of authority authorising a teacher to bind the school prior to entry being permitted.

Photography and use of equipment

6.1 Any images, recordings, or videos taken at ArtVo are for personal use only. Commercial use is prohibited without written consent.

6.2 ArtVo owns all images and recordings taken on the premises which must be delivered up and or destroyed within 24 hours upon demand by ArtVo.

6.3 Visitors consent to being photographed or recorded for promotional, advertising, or security purposes without compensation.

6.4 Mobile electronic equipment that may cause annoyance to others is not permitted.

6.5 Use of large or professional photography equipment is subject to management consent. Large tripods are prohibited without consent.

6.6 Visitors waive, to the maximum extent permitted by law, any claim including for compensation against ArtVo for the use of their image or likeness in promotional, advertising, security or operational materials.

Liability and Disclaimer

7.1 Visitors acknowledge and accept inherent risks, including tripping, falling, light-induced disorientation, and voluntarily assume any risk.

7.2 Visitors acknowledge and accept any obvious risk or dangerous activities engaged in by the Visitors and hold ArtVo. ArtVo accepts no liability or responsibility for any obvious risks or dangerous activities.

7.3 Visitors must not engage in prohibited conduct, including intentional or reckless behaviour causing harm or damage.

7.4 ArtVo’s liability is reduced if a visitor fails to comply with these Terms and Conditions, instructions, or safety measures to the maximum extent permitted by law that you have contributed to any negligence.

7.5 To the maximum extent permitted by law, ArtVo, its management, and staff shall not be liable for any loss, damage, injury, or consequential loss.

7.6 In the event of a technical fault or emergency, visitors may be detained, delayed or evacuated without compensation.

7.7 ArtVo may seek recovery for damage to property caused by visitors, supervisors or guardians. Schools will be fully liable for students on excursions, subject to any pre-excursion agreement in place. All supervisors, guardians or teachers of school students also accept personal liability.

7.8 Visitors expressly waive and release ArtVo, its staff and management from any claim, demand, liability or proceeding, to the maximum extent permitted by law.

7.9 Visitors must indemnify and hold harmless ArtVo, its officers, employees, agents and contractors from any claim or liability arising from the Visitors breach of these Terms and Conditions, wilful misconduct or negligence.

7.10 Visitors acknowledge and accept that they have been warned of all of the risks set out in these Terms and Conditions and where applicable verbally by staff or management at the ArtVo premises.

7.11 Visitors acknowledge and accept that ArtVo’s liability is reduced and limited to any apportionment of liability to other persons and third parties who have failed to take any reasonable care and who are liable for any loss or damage.

7.12 Visitors acknowledge and accept that any apology given by ArtVo staff or management is not an admission of negligence, liability or fault.

Definition

8.1 General Admission Ticket means a ticket purchased for a single admission during operational hours.

8.2 Management means employees, agents, or contractors of ArtVo authorised as managers.

8.3 ArtVo means ArtVo Interactive Art Gallery premises in Victoria and Queensland.

8.4 ArtVo Special Event Packages means packages developed for nominated city events and festivals.

8.5 Staff means employees, agents or contractors of ArtVo.

8.6 Terms and Conditions means these Terms and Conditions.

8.7 Ticket Counter means the ticket office located at the entrance of the ArtVo premises.

8.8 You means the individual ticket holder, purchaser, or person entering the premises.

8.9 Inherent Risks means any risk that is foreseeable and associated with participation at ArtVo.

8.10 Force Majeure means any event beyond the reasonable control of ArtVo, including natural disasters, pandemics, government restrictions, and other emergencies.

Place of Law

9.1 These Terms and Conditions are governed by the non-exclusive jurisdiction of the courts of Victoria and Queensland, Australia.

9.2 If any provision is held to be invalid, unlawful or unenforceable, it will be severed without affecting the validity of the remaining provisions.

9.3 ArtVo will not be liable for failure to perform obligations due to events beyond its control (Force Majeure).

9.4 These Terms and Conditions constitute the entire agreement between the parties and supersede all prior representations or agreements.

9.5 ArtVo reserves the right to amend these Terms and Conditions at any time without prior notice. Visitors are encouraged to review the latest version available at the point of entry and on the website.

9.6 Any dispute arising under these Terms and Conditions must first be referred to good faith negotiations between the parties before court proceedings may be commenced.
